This notice is being issued to inform you of the recently published Securities and Exchange Commission (SEC) order described in Fee Rate Advisory #1 for Fiscal Year 2022, in which the SEC announced the Section 31 transaction fee rate applicable to securities transactions on the exchanges and over-the-counter markets will be $22.90 per million dollars for covered sales occurring on or after May 14, 2022. Until that date, the current rate of $5.10 per million dollars will remain in effect.
Pursuant to MEMX Rule 15.1(b) in the MEMX Rulebook, Regulatory Transaction Fees equivalent to the applicable fees paid by the Exchange to the SEC pursuant to Section 31 will continue to be collected from Members engaged in the execution of transactions on the Exchange.
